Fan Bravo, Inc. (“Fanbravo,” “we,” “our,” or “us”) values your privacy. This Privacy Policy explains how we collect, use, store, and share your personal information when you use our websites, mobile applications, APIs, and related online services (collectively, the “Services”). By using the Services, you agree to this Privacy Policy and our Terms of Service.

1.Scope

This Privacy Policy applies to all Fanbravo Services that link to it, including our websites, mobile applications, communications, and APIs. It does not apply to third-party websites, applications, or services, even if accessed through Fanbravo. We encourage you to review the privacy policies of those third parties.

2.Information We Collect

We may collect the following categories of information from or about you:

  • Account Information — Name, email address, phone number, password, profile details.
  • Transaction Data — Payment details, tipping history, payout records, and related financial information.
  • NIL Compliance Information (where applicable) — University affiliation, sport, and disclosures required under NCAA, state, or federal NIL rules.
  • Content — Photos, videos, posts, and other materials you upload.
  • Technical Data — IP address, device identifiers, browser type, operating system, app version, usage data, log files.
  • Location Data — Approximate or precise geolocation if you grant permission.
  • Communications — Messages and interactions with other users or Fanbravo.
  • Third-Party Data — From payment processors, verification providers, public databases, and NIL compliance partners.

3.How We Use Your Information

We use your information to:

  • Operate, maintain, and improve the Services.
  • Process peer-to-peer support payments and manage payouts.
  • Verify eligibility and comply with NCAA, state, federal, and other NIL regulations.
  • Enforce our Terms of Service and prevent fraud or misuse.
  • Communicate with you about your account, transactions, or support requests.
  • Personalize content and user experience.
  • Conduct analytics, benchmarking, and research (using anonymized data where possible).
  • Comply with legal obligations and respond to lawful requests.

4.How We Share Your Information

We do not sell your personal information. We may share your information:

  • With Creators — When you send a tip or upload content featuring them.
  • For NIL Compliance — With universities, conferences, NCAA, NILGo, or regulators when legally required.
  • With Service Providers — Payment processors, hosting services, advertising, analytics providers, and verification services.
  • For Legal or Safety Reasons — To comply with law or protect rights, property, or safety.
  • During Business Transfers — As part of a merger, acquisition, or sale of assets.
  • With Your Consent — As otherwise directed by you.

5.Cookies and Similar Technologies

We and our service providers may use cookies, pixels, SDKs, local storage, and similar technologies to operate the Services, remember preferences, understand usage, improve performance, prevent fraud, support security, and measure marketing effectiveness.

  • Deletion. You may request that we delete personal information associated with your account, subject to legal, safety, fraud-prevention, tax, payment-processing, dispute-resolution, and compliance obligations.
  • Restriction. You may request that we restrict certain processing of your personal information.
  • Objection. You may object to certain processing based on our legitimate interests.
  • Portability. You may request a copy of certain personal information in a structured, commonly used, machine-readable format.
  • Withdraw Consent. Where we rely on consent to process your personal information, you may withdraw that consent at any time.
  • Complaint. You may have the right to lodge a complaint with a data protection authority in your country of residence.

The GDPR includes rights such as access, rectification, erasure, restriction, and related rights for data subjects.

8.Legal Bases for Processing Personal Information

For users located in the European Economic Area, the United Kingdom, or Switzerland, we process personal information under one or more of the following legal bases:

  • Performance of a contract. We process personal information to provide the Services, create and maintain accounts, allow users to post content, follow Creators, send voluntary Tips, receive payouts, and communicate through the platform.
  • Legitimate interests. We process personal information to operate, secure, improve, and promote Fanbravo; prevent fraud, abuse, spam, unauthorized activity, and misuse; enforce our Terms; maintain platform integrity; and understand how users interact with the Services.
  • Legal obligations. We process personal information where necessary to comply with applicable law, tax, accounting, payment, dispute, law enforcement, regulatory, sanctions, child safety, and platform safety obligations.
  • Consent. We process personal information based on consent where required by law, such as for certain marketing communications, cookies, device permissions, or optional features.

9.California Privacy Rights

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA), including the right to know, delete, and opt-out of the sale or sharing of personal information. Fanbravo does not sell personal information as defined under CCPA.

10.Data Retention

We retain personal information as long as necessary for the purposes outlined in this Privacy Policy. Some transaction data may be retained for at least 7 years for regulatory compliance as required by law.

11.International Data Transfers

Fanbravo is based in the United States. If you access or use the Services from outside the United States, your personal information may be processed and stored in the United States or other countries where Fanbravo, its service providers, or payment processors operate.

Where required by applicable law, we use appropriate safeguards for international transfers of personal information, which may include contractual protections or other legally recognized transfer mechanisms.

12.Security

We implement administrative, technical, and physical safeguards to protect your information, but no method is 100% secure. You use the Services at your own risk.

13.Children's Privacy

The Services are not directed to children under 13 (or the minimum age in your jurisdiction). We do not knowingly collect personal information from children without parental consent.

14.Account Deletion and Data Requests

You may request deletion of your Fanbravo account by emailing privacy@fanbravo.com or by using the account deletion tools available in the Fanbravo app, if available.

When you request account deletion, we will delete or de-identify personal information associated with your account, subject to information we are required or permitted to retain for legal, safety, fraud-prevention, payment-processing, tax, accounting, dispute-resolution, platform integrity, or compliance reasons.

User-generated content that has been shared publicly or with other users may remain visible if removal would affect the rights or experience of other users, unless removal is required by applicable law. We may also retain records necessary to document transactions, enforce our Terms, prevent abuse, and comply with legal obligations.

15.Changes to This Privacy Policy

We may update this Privacy Policy from time to time. Material changes will be communicated via the Services, email, or other reasonable means, in addition to updating the Effective Date.
